End-User Licence Agreement

This agreement governs use of the THM Fabrication app (the "App") at app.thmfabrication.com, operated by THM Fabrication ("THM"). By signing in to the App you accept these terms. If you do not accept them, do not use the App.

1. Who may use the App

The App is an internal business system. Accounts are issued by THM to its employees, contractors, bookkeepers and other people THM authorises. Clients who receive a field ticket for review or signature use the App through a link sent to them and are bound by these terms for that use.

2. Your account

• An account is personal to you. Do not share your login or let anyone else use it.
• You are responsible for what is done under your account. Tell THM at once if you think it has been compromised.
• THM may suspend or close an account at any time, including when your engagement with THM ends.

3. Acceptable use

You agree to use the App only for THM's business and only for the purpose it is provided. You must not:

• enter information you know to be false, including hours, quantities or costs;
• copy, export or disclose project, client, pricing or personnel data except as your role requires;
• attempt to access data or functions your role has not been granted;
• interfere with the App's operation or security, or reverse-engineer it.

4. Ownership

The App, its code, design and documentation are the property of THM and its licensors. Business data entered into the App belongs to THM. You receive no rights in either beyond the limited right to use the App as permitted here.

5. Connected services

The App exchanges data with third-party services THM has chosen, including Intuit QuickBooks Online for accounting, and hosting and email providers. Your use of the App through those services is also subject to their terms. THM does not control those services and is not responsible for them.

6. Availability and changes

THM may change, suspend or discontinue any part of the App at any time. THM does not promise the App will be available without interruption or free of errors.

7. No warranty and limitation of liability

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, THM is not liable for any indirect, incidental or consequential loss, or for loss of data, revenue or profit, arising from use of or inability to use the App. Nothing in this agreement limits liability that cannot be limited by law.

8. Privacy

THM's handling of personal information in the App is described in the Privacy Policy, which forms part of this agreement.

9. Termination

This agreement ends when your account is closed. Sections 4, 7 and 10 survive termination.

10. Governing law

This agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. The courts of Alberta have exclusive jurisdiction.
